The Maritime Court shall grant a ruling within forty-eight hours upon receipt of an application for ship arrest. In particular, the Chinese laws permit a movable arrest of a ship, i.e. a ship may, with the consent of the claimant, be allowed to resume operations subject to restrictions on disposing of the ship or creating a new mortgage on the ship.<\/p>\n<p>China has not acceded to the Arrest Conventions.<\/p>\n<p>There is no other way to arrest a ship with the purpose of security of the claim. However, a ship may also be arrested and sold for enforcement of a judgment, arbitration award or other enforceable legal document. Apart from arrest, no other alternatives such as saisie conservatoire or freezing order.<\/p>\n<p>See attached file: ALCO20130009 Ship Arrest in China.pdf<\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 14pt; color: #022469;\"><strong>\u56fd\u9645\u6263\u8239\u5b9e\u52a1-\u4e2d\u56fd<\/strong><\/span><\/p>\n<p>1999\u5e74\u300a\u4e2d\u534e\u4eba\u6c11\u5171\u548c\u56fd\u6d77\u4e8b\u8bc9\u8bbc\u7279\u522b\u7a0b\u5e8f\u6cd5\u300b\uff08\u4ee5\u4e0b\u7b80\u79f0MPL\uff09\u5bf9\u6263\u8239\u4f5c\u4e86\u7279\u522b\u89c4\u5b9a\u3002\u6d77\u4e8b\u6cd5\u9662\u63a5\u53d7\u6263\u8239\u7533\u8bf7\u540e\uff0c\u5e94\u5f53\u572848\u5c0f\u65f6\u5185\u4f5c\u51fa\u88c1\u5b9a\u3002\u7279\u522b\u9700\u8981\u63d0\u5230\u7684\u662f\uff0c\u4e2d\u56fd\u6cd5\u5f8b\u5141\u8bb8&#8221;\u6d3b\u6263&#8221; \uff0c\u5373\uff0c\u5728\u6d77\u4e8b\u8bf7\u6c42\u4eba\u540c\u610f\u7684\u60c5\u51b5\u4e0b\uff0c\u5141\u8bb8\u8239\u8236\u6062\u590d\u8425\u8fd0\uff0c\u4f46\u9650\u5236\u8239\u8236\u5904\u5206\u548c\u5728\u8be5\u8239\u8236\u4e0a\u589e\u8bbe\u65b0\u62b5\u62bc\u3002<\/p>\n<p>\u4e2d\u56fd\u6ca1\u6709\u52a0\u5165\u300a1999\u5e74\u56fd\u9645\u6263\u8239\u516c\u7ea6\u300b\u3002<\/p>\n<p>\u4e3a\u4e86\u7d22\u8d54\u7684\u5b89\u5168\uff0c\u6ca1\u6709\u5176\u4ed6\u6263\u8239\u65b9\u5f0f\u3002\u4f46\u662f\uff0c\u6709\u53ef\u80fd\u56e0\u6267\u884c\u5224\u51b3\u3001\u4ef2\u88c1\u88c1\u51b3\u6216\u5176\u4ed6\u53ef\u6267\u884c\u7684\u6cd5\u5f8b\u6587\u4e66\u800c\u6263\u62bc\u6216\u4e70\u5356\u8239\u8236\u3002\u9664\u4e86\u6263\u8239\uff0c\u6ca1\u6709\u5176\u4ed6\u53ef\u66ff\u4ee3\u7684\u65b9\u5f0f\uff0c\u5982\u4fdd\u5168\u6263\u62bc\u6216\u51bb\u7ed3\u4ee4\u3002<\/p>\n<p>\u8be6\u7ec6\u4fe1\u606f\u8bf7\u53c2\u9605\u9644\u4ef6\u3002<\/p>\n<p><span style=\"font-size: 14pt; color: #022469;\"><strong><br \/><\/strong><\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>&nbsp;&nbsp;ENG &nbsp;&nbsp;&nbsp;CHN The Maritime Procedure Law of the People&#8217;s Republic of China, 1999 (hereinafter referred to as MPL) provides specific rules for the arrest of ships.
