Hong Kong is a Special Administration Region (SAR) of the People’s Republic of China (PRC). As such it has a separate and distinct legal system from that of the PRC. Hong Kong has a common law system of justice which developed during the years when it was a British colony.<\/p>\n

A ship – or one of its sister ships – may be arrested where:
– a claimant’s cause of action carries with it a right of arrest;
– an in rem writ has been issued;
– the ship is available in Hong Kong; and
– no caveat against arrest has been entered.<\/p>\n

The Brussels Convention 1952, as enacted in English legislation applies to arrest of ships in Hong Kong.<\/p>\n

There is no other way to arrest a ship in Kong Hong jurisdiction. It is possible to get an injunction. This is more difficult and expensive than arresting the ship. Civil Justice Reforms were implemented in April 2009. Innovations in the regime have put interim relief, similar to saisie, into effect. The new reforms have opened up Hong Kong to claims where injunctions are available to provide support and security for foreign proceedings.<\/p>\n

\u5982\u679c\u6ee1\u8db3\u4ee5\u4e0b\u6761\u4ef6\uff0c\u8239\u8236\u6216\u5176\u59d0\u59b9\u8239\u53ef\u4ee5\u88ab\u6263\u62bc:
– \u539f\u544a\u7684\u8bc9\u56e0\u4f7f\u5176\u6709\u6743\u6263\u62bc\u8239\u8236
– \u5df2\u7b7e\u53d1\u5bf9\u7269\u8bc9\u8bbc\u7684\u6587\u4e66
– \u9999\u6e2f\u80fd\u591f\u6263\u5230\u8be5\u8239
– \u6ca1\u6709\u4eba\u7533\u8bf7\u4e2d\u6b62\u6263\u62bc<\/p>\n

\u82f1\u56fd\u662f\u300a1952\u5e74\u5e03\u9c81\u585e\u5c14\u516c\u7ea6\u300b\u6210\u5458\u56fd\uff0c\u5728\u9999\u6e2f\u6263\u8239\u9700\u9075\u5b88\u8be5\u516c\u7ea6\u7684\u89c4\u5b9a\u3002<\/p>\n

\u9664\u6b64\u4ee5\u5916\uff0c\u6ca1\u6709\u5176\u4ed6\u7684\u6263\u8239\u65b9\u5f0f\u3002\u53ef\u4ee5\u7533\u8bf7\u7981\u4ee4\uff0c\u4f46\u662f\u7533\u8bf7\u7981\u4ee4\u6bd4\u6263\u8239\u66f4\u56f0\u96be\u800c\u4e14\u4ee3\u4ef7\u9ad8\u6602\u30022009\u5e744\u6708\uff0c\u9999\u6e2f\u5b9e\u884c\u4e86\u6c11\u4e8b\u53f8\u6cd5\u5236\u5ea6\u6539\u9769\u3002\u653f\u6cbb\u6539\u9769\u65f6\u6709\u8fc7\u6e21\u65f6\u671f\u7684\u6551\u6d4e\u63aa\u65bd\uff0c\u65b0\u7684\u6539\u9769\u4f7f\u5f97\u5728\u9999\u6e2f\u53ef\u4ee5\u53d6\u5f97\u7981\u4ee4\uff0c\u7528\u4ee5\u7ed9\u5916\u56fd\u7684\u8bc9\u8bbc\u7a0b\u5e8f\u63d0\u4f9b\u652f\u6301\u548c\u4fdd\u5168\u3002<\/p>\n
