Sebat Shipping and Trading Company (“船东”) 与Trans Trade RK SA (“租家”) 于2022年4月9日订立Fixture Recap。船东同意将MV Sebat程租给租家去运一票从罗马尼亚到德国的粮食货物。

该船,在装货之后,即前往卸货港。该船于2022年5月10日到达卸货港,随即递交了卸货准备就绪通知书(“NOR”)。但是,在后续的仲裁中,仲裁庭判定当时的这个NOR是无效的。船东后续也并未递交任何新的NOR。

该船于2022年5月13日靠泊。于5月14日,该船开舱盖准备卸货。但是由于舱内的phosphine浓度过高,卸货无法进行。该船随后去了锚地。直到2022年7月27日,该船才重新靠泊,并于7月30日完成卸货。

因此,船东跟租家索赔了高额的卸港滞期费。但是租家拒绝支付。租家的理由是船长在卸港递交的NOR无效,所以laytime并未起算。

Trans Trade RK SA v Sebat Shipping and Trading Company (The “Sebat”) [2026] EWHC 950 (Comm) (the “Judgment”)

Pursuant to a fixture recap dated 9 April 2022 (incorporating the Synacomex 2000 form), Sebat Shipping and Trading Company (the “Owners”) agreed to voyage charter MV Sebat (the “Vessel”) to Trans Trade RK SA (the “Charterers”) for the carriage of a cargo of Ukrainian barley from Constanta, Romania, to Brake, Germany.

After loading her cargo, the Vessel proceeded to the discharge port. On 10 May 2022, at the discharge port, the Vessel tendered her NOR. In arbitration, the Tribunal found that the NOR was invalid. No further NOR had been served.

The Vessel subsequently berthed on 13 May. On 14 May, the Vessel’s hatches were opened in preparation for discharge operations, but discharge was prevented from commencing due to high phosphine levels. The Vessel was then ordered to leave the berth and to return to the anchorage. The Vessel did not berth again until 27 July 2022. Discharge operations eventually completed on 30 July.

As a result, Owners claimed significant demurrage at the discharge port, which Charterers challenged on the basis that no valid NOR had been served, and therefore, laytime never commenced.
