定期租船合同中,船上燃油通常在交船时结算成为承租人财产,由承租人确保还船时在船油量与交船时大致相同,并负责合同履行期间的燃油供应。

但实际履行过程中,船舶实际的油耗水平容易受多方面因素影响,且交还船时涉及的燃油数量大。即便有出租人及船长的协助,承租人也未必每航次都能精准判断供应的燃油数量。这导致日常还船油量纠纷屡见不鲜。在油价波动剧烈时,如何解决还船油量差甚至直接决定租用双方的履约收益。

Under time charter parties, property in bunkers on board were usually transferred to charterers on delivery who were responsible for the supply of bunkers intended for the performance of charter parties and further obliged to stem appropriate quantity of bunker to make sure vessels were redelivered with the agreed quantities on board.

However, in practice, a vessel’s fuel consumption is susceptible to external factors, and the bunker quantity required at delivery and redelivery are substantial. Even with the assistance of the Owners and the Master, Charterers may not be able to determine the exact quantity of bunkers required or control the bunker quantity supplied. This frequently leads to disputes regarding BOR quantities. When there are wild fluctuations in bunker markets, how to resolve such disputes may determine whether they gain or loss from the performance of charter parties.
