在2024年7月16日由高等法院商事法庭（审理法官： Foxton）审理的 MS Amlin Marine NV 诉 King Trader Ltd Others [2024] EWHC 1813 (Comm) （The Solomon Trader）一案中，判决对于破产的被保险人，其保单下的保险人受到“先付条款”的保护。

INSOLVENT INSURED & THIRD-PARTY CLAIMS
In a new case of MS Amlin Marine NV v King Trader Ltd and Others [2024] EWHC 1813 (Comm) – King’s Bench Division, Commercial Court (Mr Justice Foxton) – 16 July 2024, where it was decided that insurers of the insolvent assured under the policy are protected by the “pay to be paid” rule.
