Costs Issues of Any Arbitration Is As Important As Substantive Legal Dispute
In a new arbitration case (2022) 1123 LMLN 2, that with the issue of costs after a Partial Final Award, many issues were highlighted.
In this case, a ship Yard and Ship owner had a very complicated legal dispute. Yard won a substantial sum from the Owners in total. On this basis, they applied for most of the costs of arbitration to be given in favour. Owners also won small counterclaim and also on the legal issue of duress, but overall they had to pay money to the Yard.
