In the case of Pan Ocean Co Ltd v Daelim Corporation [2023] EWHC 391 (Comm) – King’s Bench Division, Commercial Court, Sir Ross Cranston – 24 February 2023, novel arguments came before the court in relation to implied term(s) in a charterparty. In this case, the Claimant Charterers, Pan Ocean Co Ltd, appealed against an arbitration award in favour of the vessel’s Owners, Daelim Corporation.
