自二零一二年一月一日开始,根据《中华人民共和国防治船舶污染海洋环境管理条例》,任何承运带有污染性及危险性散装货物的船舶,或任何其他超过10,000 GT的船舶,在进入任何中国港口前,船东及船舶营运人必需和中国港口与海事安全局认可的船舶污染清除单位签订船舶污染清除协议。

于二零一二年九月十四日,中国海事局对另外一个同于二零一二年一月一日生效的船舶污染的有关法律,《中华人民共和国海事局船舶污染清除协议管理制度实施细则》(以下简称《细则》)进行修订。

中国海事局把进行了修订的溢油应急合同范本附加到修订后的细则中。该合同只由两个条文组成,均为强制条文。这两个强制条文加入了两个新的要求,包括船对船加油时的防油栅及船舶污染清除单位协助联合船舶污染应急演习(2.4条及2.5条)。虽然合同中只有两条强制性条文,但船东/船舶营运人和认可的承办商可就该协议相关的其他事项约定并作为该协议的组成部分。我们现附上国际保赔协会所建议的溢油应急合同供大家参考。

附件中的建议合同是完全附合国际保赔协会的指导方针的。如船东/船舶营运人被要求更改合同内容,请确保该更改不会超出保赔协会的承保范围。如船东/船舶营运人在合同上有任何疑问,我们建议在签任何溢油应急合同前先咨询你们的保赔协会以保护你们的利益。

Update on the Regulations of the People’s Republic of China on the prevention and control of marine pollution from ships

From 1 January 2012, according to the Regulations of the People’s Republic of China (PRC) on the Prevention and Control of Marine Pollution from Ships (“the Regulations” ), Owners/Operators of (a) any ship carrying polluting and hazardous cargoes in bulk or (b) any other ship above 10,000 GT are required to enter into a pollution clean-up contract with a Maritime Safety Agency (MSA) approved ship pollution response company (SPRO) before the ship enters a PRC port.

On 14 September 2012, the China MSA made some amendments on another pollution regulation, Detailed Rules on the Implementation of the Administration Regime of Agreement for Ship Pollution Response, which came into force on 1 January 2012.

The China MSA has issued an amended model spill response contract attached to the revised Detailed Rules. The model contract consists of only two articles, both of them are mandatory. These mandatory articles introduce two new requirements that of booming during ship-to-ship transfers and a requirement that the SPRO assists in joint emergency exercises (Article 2.4 and 2.5). Although there are just two mandatory articles, both Owners/Operators and approved contractor may conclude supplemental articles as part of the agreement. We herewith attach the revised IG recommended spill response contract for your reference.

The recommended contract attached conforms with the International Group’s Guidelines. Owners/Operators requested to agree to a variation of the attached recommended contract are advised to check with the P&I Club or insurer to make sure such variations do not cause the contact to fall outside the scope of the IG Guidelines. Moreover, if Owners/Operators are in any doubt about the contact, they are suggested to consult their P&I Club or insurer before contracting with any SPRO.
