国内多起由于装运镍矿导致船舶全损的事故(包括Jian Fu Star, NASCO Diamond和Hong Wei),我们都参与了处理。
这几个案子中,船壳保险人和保赔保险人都只选择向装运该危险货的租家索赔。由于租家是皮包公司或者没有购买租家责任险等原因,其中两个案子的索赔以失败告终。
奇怪的是,没有一个案子的船壳和保赔保险人选择向货主提出索赔。

Carrier’s rights to recover loss to ship from the cargo owners due to hazardous cargoes
We have been involved in each of the total loss casualties on Chinese vessels (Jian Fu Star, NASCO Diamond and Hong Wei) arising from the carriage of nickel ore.
In each case the Hull insurers and the P&I insurers have only considered their options to claim their losses from the charterer for loading a hazardous cargo, however in two of the above cases the recovery action was unsuccessful in view the charterers were paper companies and or had no charterers liability insurance cover.
We are surprised that in each case the Hull and P&I insurers have not considered the option to seek recourse against the cargo owners.
