在装运易液化货物时,对于货物是否适合安全运输,船东和租家不时发生争议。紧接着就必须拿样品去实验室做检测,以确定货物的适运水分限量(以下简称TML),这样就不可避免产生时间损失。

从我们处理的大量案子来看,保赔协会对此类问题的意见是:提供安全货物是发货人的严格责任,如果货物TML值与发货人之前宣称的不同或超过,那么无论船东在确定TML值过程中是否有过失,船舶所有的时间损失都应该由租家承担。

Dangerous cargoes

Disputes between owners and charterers are frequent when loading cargoes which may liquefy on the matter whether the cargo is safe for carriage, and the ensuing time loss arising from sampling and laboratory testing to determine the TML.

Based on the numerous number of cases we are handling, it appears the view and stance taken by the P&I Clubs is that the shippers are under a strict liability to provide a safe cargo and in the event it turns out the TML is different or exceeds the figure which is declared by the shipper, all time loss of the vessel is borne by the charterer regardless the owner had been negligent during the course of determining the TML.
