尽管《国际船舶压载水和沉积物控制和管理公约》（《压载水公约》）还没有生效，有许多国家已经制定了国内法来管理压载水的排放。我司在此谨提醒您美国海岸警卫队在2012年3月23日发布了有关压载水排放的最新法规，此法规将会在发布后90天，即2012年6月21日生效。有关美国压载水排放标准的具体信息，请参考由美国保赔协会发布的第11/12号公告。实际上，美国海岸警卫队要求的压载水排放标准与《压载水公约》采用的标准是一致的。
但是，纽约州和加州都发布了其州法律来规制压载水排放，并且两州都比美国海岸警卫队和《压载水公约》的标准严格许多。纽约州的要求几乎是活体生物的零排放。因此海事业界一致地对这些标准是否是可行的持怀疑态度。幸运的是，纽约州已经在2012年2月23日修订了其压载水排放要求，延长了船东要遵守此州法规的最后期限。因此，一直到2013年底纽约州对于压载水的严苛要求都被排除了。加州也发布了通知建议修订有关压载水管理的法规，请等待之后的更新。
除了美国之外，还有其他国家也制定了压载水管理的国内法，比如巴西、澳大利亚、阿根廷和智利。若贵司的船舶是前往这些国家的，请注意港口方有关压载水排放标准的规定。申请对于压载水排放标准的延期或豁免有可能是被允许的，比如在纽约州，那么贵司的船舶可以向相关的机构（请具体参照当地法规）进行申请。
如果贵司有新造船舶的计划，请确保新造船舶是适合于安装要求的压载水管理系统，比如安装的空间和位置等。

Ballast water management alert
Even though the International Convention for the Control and Management of Ship’s Ballast Water and Sediments (Ballast Water Convention) has not come into force yet, many countries have made their own regulations to manage ballast water discharge. We hereby kindly remind you that the United States Coast Guard (USCG) published new regulations regarding ballast water discharges on March 23, 2012 and the new regulations will become effective after 90 days after publication, namely June 21, 2012. For the details of US ballast water discharge standards (BWDS), please refer to the Circular No.11/12 provided by the American Club. Actually, the BWDS required by USCG is consistent with that adopted by Ballast Water Convention.
However the New York State and the California State both published their own state rules to regulate ballast water discharges, and both are much stricter than BWDS required by USCG and Ballast Water Convention. The requirement of New York State is nearly zero draining of organisms. Therefore the maritime industry always doubts whether these standards are workable. Fortunately, the New York State has modified its ballast water discharge permit on February 23, 2012 and extended the deadline by which ship owners have to comply with state rules. Thus the onerous ballast water treatment requirements have been effectively eliminated through the end of 2013. The California State also issued a letter advising that it is proposing amendments to regulations for ballast water management, please wait expectantly for updates.
In addition to US, there are also other countries published their own relations regarding ballast water management, such as Brazil, Australia, Argentina, and Chile. If your vessels are heading to these countries, please be aware of the BWDS of the port. Extension or exemption for BWDS may be allowed such as in the New York State rules, your vessels can apply for that from relevant authorities (please refer to local government regulations).
If your good company has plans to build new vessels, please make sure that new buildings are suitable for installation of required ballast water management systems, such as the installing space and position etc.
