1. 关于紧急绕航情况下的保赔险保险范围
在我们处理的最近一起船员受伤案件中, 船舶为了紧急让船员下船得到治疗不得已绕航。这样做的后果可能导致船东对在绕航中的船壳险和保赔险能够能得到保赔协会赔偿的问题产生疑问。
我们诚挚提请您注意Steamship Mutual互保协会规则25条以及协会对该规则作出的解释,该协会25条内容大致如下:
「….. 能够得到赔偿的费用只限于燃料、保险、船员工资、仓储、供给费用和港口费用,而不包括由会员引起的而由绕航行为之外而产生的任何费用。」
协会进一步指出,协会只会赔偿在规则中明示的费用。根据协会的进一步解释,船壳险和保赔险保费是船舶的常规保费,所以不能被视为由绕航产生的增加的费用。
基于以上原因,操作费用、折旧费用和杂费也在协会承保的范围之外。
2. 处理海盗问题的小贴士
在冬季过去之后,亚丁湾的海盗活动据报道正愈演愈烈。我们诚挚提醒我们的客户在通过亚丁湾时应当将通过的情况通知船旗国,以便加入护航。中国船东也最好能够联系中国船东互保协会以求协助。
除了参加海军护航之外,我们也可以通过购买保险以提供给我们的客户一个风险转移机制。为一位拥有将通过亚丁湾这样高危区域的船东,我们建议我们的客户购买以下保险以在万一有海盗攻击的情况下保护您的经济利益。
– 劫持和赎金险
– 战争违约险 (可以在战争险中加入海盗险)
– 战争租金损失险/海盗租金损失险/劫持租金损失险

We would like to share with you two pieces of important information.
1. P&I Coverage referring to deviation in emergency
In a recent Crew Injury case which is being dealt by us, the vessel deviated for emergency landing injured or sick crew for medical treatment. This might arise the question whether the premium for P&I and H&M insurance would be covered by the Club.
We would kindly draw your attention to the interpretation of Steamship Mutual Rule 25 which reads as following:
“….. the expenses recoverable are limited to the costs of fuel, insurance, crew wages, stores, provision and port charges, less any savings in expenditure which would have been incurred by the Member but for the deviation.”
As further clarified by the Club, the Club would only cover the expenses expressly state in the Rule. Furthermore as explained by the Club, H&M or P&I premium is the s normal premium, which shall not be regarded as the enhanced cost for the deviation.vessel
For the reason above, the operation cost, depreciation and miscellaneous expense will also fall outside the Club cover.
2. Tips of Piracy Handling
The piracy activities in the Gulf of Aden are reported to be reactive after the winter season. We would like to remind our clients that one shall contact the s flag state for the transit in order to join a convoy. Chinese Owners are also encouraged to contact the China PNI for assistance. vessel
Apart from joining the convoy by military navy, we are able to provide our clients a risk transferring mechanism by means of insurance. To owners whose ships will transit Gulf of Aden and high risk areas, we will recommend our clients to have the following insurance covers to protect your economic risks against pirates attack:
– Kidnap and Ransom.
– Breach cover from war risk (you may add piracy risk to the war risk cover).
– War risk loss of hire / piracy risk loss of hire / hijacking loss of hire.
