Customary trade allowance
The following is an extract from an IG Club’s newsletter.
“Contrary to popular belief, there is generally no accepted legal principle that a carrier need deliver only 99.5% of the cargo stated on the bill of lading and that a customary shortage of 0.5% of the cargo is automatically acceptable.
Both American and English courts reject the idea of a ‘customary’ allowance. but accept there are a multitude of reasons why the quantity of bulk cargoes appear to differ from the quantities allegedly placed on board.”
Our further research however shows that contrary to the above advices, the idea of a ‘customary’ trade allowance is accepted in many jurisdictions and by some courts.
