不少货主关心他们投保的海上货物保险是否保障因海盗袭击引起的货物灭失或损坏，尤其是到亚丁湾、印度洋或中东等的海盗高风险区的航次。是否可以得到保障，取决于海上货物保险单的条款措辞。
通常，海上货物保险单采用协会货物条款(A) – 1/1/82（以下简称ICC(A)条款）。根据ICC(A)条款，保障投保货物灭失或损坏的一切风险。这意味着因海盗袭击引起的投保货物的灭失或损坏可以得到赔偿。尽管除外条款6.2排除了”捕获、扣押、扣留、拘禁或羁押” ，但是海盗风险不属于此项除外条款事项。

Is Piracy risk covered by the Marine Cargo Insurance？
Some cargo owners concern about whether the Marine Cargo Insurance arranged could cover the loss of or damage to cargoes arising from Piracy attack, especially for the voyages to the Piracy high risks area like Gulf of Aden, Indian Ocean or Middle East. It depends on the clause wordings of the Marine Cargo Insurance policy.
It is common that Institute Cargo Clauses (A) – 1/1/82 (herein referred to as “ICC(A)” ) is adopted in the Marine Cargo Insurance policy. As per ICC (A), it covers all risks of loss of or damage to the insured cargoes, which means the loss of or damage to insured cargoes arising from piracy attack are covered. Although “capture, seizure, arrest, restraint or detainment” are excluded in exclusion clause 6.2, piracy risk is excepted in this clause.
