近期一些钢材货物损坏索赔案件的判决表明,船东需要比以往更加恪尽职守,确保船舶适货。

在某些司法辖区,如果船舶缺少船舱通风设备,则船东将承担货损责任。

适当的定期通风记录,有助于船东抗辩这样的货损索赔,其他有益于船东的记录包括海水温度记录、环境中的干湿球温度记录、钢材表面温度记录等。

最近,澳大利亚法院认定,如果货舱条件可能引起冷凝,即使船东在航行过程中对船舱通风已做到恪尽职守, 船东仍需要对货舱汗水导致的钢材锈损负责。法院认为,如果在船上安装除湿机并非不可能,那么当存在冷凝风险时,船东就有义务提供货舱除湿设备。

船东可以通过租约中的附加条款将此类索赔的风险和/或安装船上除湿设备的费用转嫁到租家身上。

Steel cargo claims

Recent judgments in steel cargo damage claims means shipowners need to exercise a greater amount of due diligence in ensuring the vessel is cargo worthy than previously expected of the shipowner.

A lack of ventilation in the cargo holds in some jurisdictions mean the owners will be held liable for the cargo damage.

Proper ventilation records at regular intervals may assist the owners to defend such claims and will include record of the seawater temperature, the ambient wet and dry bulb temperatures and surface temperature of the steel.

The Australian Courts have recently held the owner is liable for a condensation claim to steel cargoes if the conditions are likely which may cause condensation in a cargo hold even if the owners have exercised due diligence in ventilating the cargo holds during the voyage. It was held the owner was obliged to supply dehumidifier equipment in the cargo holds as the risk of condensation was possible, if putting dehumidifiers on board was not something which was not impossible to do.

Additional clauses in charterparties may transfer the risk of such claims and or transfer the cost of putting dehumidifier equipment on board the vessel onto the charterers.
