Cargo Claim – What happens if no one is a fault: Inter Club Agreement

In a recent case of Transgrain Shipping (Singapore) PTE Ltd v. Yangtze Navigation (Hong Kong) Co Ltd & Anor (MV Yangtze Xing Hua) [2016] EWHC 3132 (Comm), it was decided by the Commercial Court that Inter-Club agreement (ICA agreement) between the Charterers and the Owners is governed by the understanding that this is incorporated in the charterparty to avoid long delay and to avoid benefitting the lawyers out of costly litigation in these cargo claims. The ICA agreement is introduced in the charterparty through an appropriate ICA clause.
