据最新消息:欧盟很可能会同意,在7月1日以前暂时解除欧洲保险公司为伊朗原油运输服务提供保险的禁令。迫于韩国,印度,中国和日本等国家的施压,欧盟针对伊朗禁令的态度在本周的讨论中有所缓和,并将于今天达成协议。

根据协议,在7月1日以前,非欧盟国家的买方可以继续从伊朗购买并运输石油,安排货物和运输保险。除非另有决议,7月1日终止该暂时解除禁令的协议。

欧盟于上周五决定,在7月1日以前解除为伊朗与非欧盟国家间原油运输提供保险的禁令。

今年五月欧盟将再次举行会议,以决定在7月1日之后是否延长解除禁令的期限。

根据3月23日发布的欧盟7854/12号公告,欧盟即日将公布官方文件。对此,我司会紧密跟踪,及时通告。

欧盟就暂时解除伊朗原油运输保险禁令达成协议- 3月27日更新

继我司26日的通函,附件为欧盟2012年3月23日通过的267/2012号决议。

根据决议第12条第二款,欧盟在2012年7月1日以前暂时解除为伊朗与非欧盟国家间原油运输提供保险的禁令。

EU Proposal about Iran Sanctions – 23 Mar

EU will very likely agree to continue to provide insurance cover for shipments of oil from Iran before the full embargo starts on 1st July. There have been discussions this week and EU has appeared to be more flexible due to heavy pressure from countries such as Korea, India, China and Japan, however the decision by EU states to legalise this proposal is to be taken today.

This proposal will allow buyers in non EU countries to purchase and carry oil shipments until the 1st July as insurances on cargo and ships would be permissible. This exemption is allowed until 1st July and unless there is another decision there will be no The EU decided last Friday to agree to the exemption for insurances on shipments of Iran oil to non EU countries to be permitted until the 1st July.

There is proposed to be another meeting in May to decide whether to extend this exemption after the 1st July.

As advised by EU press release 7854/12, a consolidated version of the relevant regulation will be published in the Official Journal. We will keep you updated once get the details.

Further our last circular on 26 March, enclosed below is the Council Regulation (EU) No 267/2012 for your reference.

According to Article 12(2) Exemption for insurances on shipments of Iran oil to non EU countries are permitted until the 1st July.

Council Regulation (EU) No 267/2012 of 23 March 2012 concerning restrictive measures against Iran and repealing Regulation (EU) No 961/2010

Article 11
1. It shall be prohibited:

a.to import crude oil or petroleum products into the Union if they:
(i) originate in Iran; oren 24.3.2012 Official Journal of the European Union L 88/7
(ii) have been exported from Iran;
b.to purchase crude oil or petroleum products which are located in or which originated in Iran;
c.to transport crude oil or petroleum products if they originate in Iran, or are being exported from Iran to any other country; and
d.to provide, directly or indirectly, financing or financial assistance, including financial derivatives, as well as insurance and re-insurance related to the import, purchase or transport of crude oil and petroleum products of Iranian origin or that have been imported from Iran.

2. Crude oil and petroleum products means the products listed in Annex IV.

Article 12
1. The prohibitions in Article 11 shall not apply to:

a.the execution until 1 July 2012, of trade contracts concluded before 23 January 2012, or of ancillary contracts necessary for the execution of such contracts;
b.the execution of contracts concluded before 23 January 2012, or of ancillary contracts, necessary for the execution of such contracts, where such a contract specifically provides that the supply of Iranian crude oil and petroleum products or the proceeds derived from their supply are for the reimbursement of outstanding amounts to persons, entities or bodies under the jurisdiction of Member States,
c.the import, purchase and transport of crude oil or petroleum products which had been exported from Iran prior to 23 January 2012, or where the export was made pursuant to point (a) on or prior to 1 July 2012; or where the export was made pursuant to point (b); provided that the person, entity or body seeking to perform the contract concerned has notified, at least 20 working days in advance, the activity or transaction to the competent authority of the Member State in which it is established.

2. The prohibition in Article 11(1)(d) shall not apply to the provision, until 1 July 2012, directly or indirectly, of third party liability insurance and environmental liability insurance and reinsurance.

Article 13
1. It shall be prohibited

a.to import petrochemical products into the Union if they:
(i) originate in Iran; or
(ii) have been exported from Iran;
b.to purchase petrochemical products which are located in or which originated in Iran;
c.to transport petrochemical products if they originate in Iran, or are being exported from Iran to any other country; and
d.to provide, directly or indirectly, financing or financial assistance, including financial derivatives, as well as insurance and re-insurance related to the import, purchase or transport of petrochemical products of Iranian origin or that have been imported from Iran.

2. Petrochemical products means the products listed in Annex V.

Article 14
1. The prohibitions in Article 13 shall not apply to:

a.the execution until 1 May 2012, of trade contracts concluded before 23 January 2012, or of ancillary contracts necessary for the execution of such contracts;
b.the execution of contracts concluded before 23 January 2012, or of ancillary contracts, including transport or insurance contracts, necessary for the execution of such contracts, where a contract specifically provides that the supply of Iranian petrochemical products or the proceeds derived from their supply are for the reimbursement of outstanding amounts to persons, entities or bodies under the jurisdiction of Member States;
c.the import, purchase and transport of petrochemical products which had been exported from Iran prior to 23 January 2012, or where the export was made pursuant to point (b), on or prior to 1 May 2012, provided that the person, entity or body seeking to perform the contract concerned has notified, at least 20 working days in advance, the activity or transaction to the competent authority of the Member State in which it is established.
