2012年4月印度发布《2012年印度商船条例》(Indian Merchant Shipping Rule 2012)。 该条例适用于300总吨以上,驶入或驶出印度领水的港口、码头、锚地或寻求港口设施或印度海上设施的非印度船舶。
该类船舶需要遵守《1996年海事赔偿责任限制公约》的规定,投保保险覆盖海事索赔。另外,条例要求以下船舶需拥有由国际船级社协会下属会员船级社颁发的船级证书。
- 20年以上船龄的石油产品船或化学品船
- 25年以上船龄的杂货船、散货船、海洋石油支持船、客船及其他种类的货船
- 30年以上船龄的液化天然气船或液化石油气船
根据条例,船舶经营人需在48小时前直接或通过航运代理向相关港口当局提交保单和船级证书的副本。另外,船东/经营人需确保船舶停留在条例规定的区域内时,保单和船级证书有效。同时在船上保留保单和船级证书的原件,以备检查所需。
为了清晰起见,条例将”保赔险”定义为”由IG保赔协会或其他得到印度政府即时授权的保险公司提供”。但是,条例没有规定印度政府为其他保险公司提供授权的程序。
显然,条例一旦生效,该举措将对大量外国船舶产生影响。7月19日印度航运部下令组成委员会,针对如何评估保赔协会、保险公司和船级社出具一份指南。
当委员会正在为如何评估收到的申请起草指南时,印度航运联合秘书处却保证,非IG协会投保的船舶靠印度港时,采用具体事件具体分析的方法,根据当地港口要求,在48小时内进行评估。
我们强烈建议被保险人在同意船舶停靠印度任何港口前,尽早通知其指定的当地代理,避免不应有的延迟。

India – Merchant Shipping Rule 2012
The Indian Merchant Shipping Rule 2012 that was published in April 2012. The regulation applies to non Indian vessels above 300 GT entering into or sailing out of ports, terminals, anchorages or seeking port facilities or Indian offshore facilities in Indian territorial waters.
These vessels will be required to be in possessions of insurance coverage against maritime claims subject to the terms established in LLMC 1996.
In addition, the following vessels shall be required to be classed with a classification society member of the International Association of Classification Societies:
- Oil product or chemical tankers older than 20 years.
- General cargo ships or bulk carriers or offshore support vessels or passenger vessels or any other type of cargo vessels older than 25 years.
- Liquefied natural gas or liquefied petroleum gas tankers older than 30 years.
The operator of a vessel subject to this regulation shall submit either directly or through a shipping agent copies of insurance policy and Certificate of Class of the vessel to the pertinent Port Authority forty eight hours in advance.
In addition the owner/operator ensures the validity of the insurance policy and the Certificate of Class during the vessel’s stay within the areas subject to this regulation, as well as to keep originals on board and available for inspection.
In its quest for clarity the Regulation sought to define “protection and indemnity insurance” as “that provided by the members of the International Group of Protection and Indemnity Clubs or such other Insurance Company as authorised from time to time by the Government of India.” The Regulation, however, fell short of establishing a procedure for those other Insurance Companies to be authorised.
When it became evident that once in force this measure affected many foreign ships, the Ministry of Shipping issued an Order on the 19th of July constituting a Committee for recommending the guidelines for evaluation of P&I Clubs, insurance companies and classification societies.
Whilst the Committee works on the guidelines for evaluation of applications received, the Indian Joint Secretary of Shipping has provided his assurances that applications to call India by vessels covered by non IG Clubs will be reviewed within 48 hours on a case by case basis, subject to compliance with Local Port requirement.
We strongly recommend our assured to notify their appointed local agents prior to agreeing calling any Indian port as early as possible to avoid undue delays.
