美国CISADA公约- Comprehensive Iran Sanctions Accountability And Divestment Act of 2010
Members will be aware that the International Community is taking concerted action against the Islamic Republic of Iran. We are to highlight some of the multinational action against Iran for ship owners and charterers attention.
There is an EU Regulation EU961.2010 which came into force on 25/10/10, applies to trade with Iran if the cargo is being exported from or to the EU, and broadened the scope of financial sanctions targeting Iran. EU961/2010 names a number of parties and organizations subject to asset freezing- see Article 16 and the related Annex in the Regulation. Even though your trade is not connected with the EU and hence in principle should not apply to this voyage, nobody knows currently how extensive the EU regulations are and it would be worth checking that the shipper is not one of these named parties.
It would also be necessary to check the list of named parties in UN SCR 1929(2010) to see if the shipper is included.
US legislation CISADA applies to voyage which primarily relates to refined petroleum products or or the import to Iran of other similar cargoes. CISADA may also apply to any form of support for the development of Iran’s direct domestic refining capacity and would include the shipment of materials, provision of services, technical support or finance for such development.In essence CISADA is domestic US legislation and determines that the US government will enforce sanctions against any party which provides to Iran refined petroleum products (RPP) with a value greater than US$1M or an aggregate value of US$5M over a 12 month period.CISADA also determines that sanctions will be applied to any party which could directly and significantly facilitate the maintenance or expansion of Iran’s domestic production of refined petroleum products, including any direct and significant assistance with respect to the construction, modernisation or repair of petroleum refineries.
A breach of CISADA or the EU regulations will result in sanctions and Club cover will cease automatically。
If the voyage is lawful and does not breach CISADA or the EU regulations, Club cover would continue. You would need to be aware that although the Clubs can provide their letters of security in Iran, claimants in Iran have usually rejected to accept Club LOUs and require bank guarantees, No Clubs are in a position to provide bank guarantees to an Iranian party and in these situations it is inevitable the shipowner will end up putting his own cash in Iran as security.

关于船舶在伊朗进行运输活动所需注意事项的通函

2010年10月25日,欧盟EU961/2010规则开始生效,适用从伊朗出口到欧盟或者欧盟出口到伊朗的贸易,规则加大了对伊朗进行经济制裁的力度。EU961/2010规则列明了众多受到资产冻结的个人、团体和组织,详见规则第16章和相关附件。即使船公司进行的运输表面上与欧盟没有联系,原则上不适用该规则,我们还是建议检查发货人是否属于规则列明的个人、团体或组织。因为目前还无法判断EU961/2010的效力范围。
联合国UN SCR 1929(2010)号文件也有一个受制裁团体的名单,我们建议船公司在进行相关运输时可以检查发货人是否在受制裁的名单之内。
美国CISADA公约适用于精练石油制品或者进口到伊朗的其他类似货物。公约同时适用那些与提高伊朗国内炼油能力相关的活动,包括材料运输,提供服务,技术以及资金支持等方面。根据公约规定,任何向伊朗提供价值超过100万美金或1年累次超过500万美金的精练石油制品(RPP-refined petroleum products)的机构,将依法受到美国政府的制裁。同时,任何直接并显著促进或维持伊朗国内制造石油精练产品能力的行为,包括对建设、维护石油精练厂有直接并显著意义的行为都将受到美国政府的制裁。
如果因为违反美国CISASA公约或者欧盟相关规则而受到制裁,协会保单会自动失效。
如果航次合法,并不违反CISADA公约或者欧盟的公约,协会保单是有效的。但是要注意的是,虽然很多协会都可以在伊朗出具担保,但是伊朗境内的索赔方通常会拒绝接受协会担保而要求提供银行担保,这点协会是很难做到的,所以很可能船东最后只能自己在伊朗提供现金担保。
