最近,国际保赔协会发布了一则关于直接还原铁(C)的通函,我们亦想借此提醒各位客户预备装运直接还原铁(C)上的事宜。有时候货主供运的货物虽然在货物的描述上没有直接还原铁(C)在内,但事实上,这些货物存有相当比例的直接还原铁(C)。而在描述上就含有直接还原铁(C)成分的货物,应该要使用适当的散装货物运输名称(BCSN),而且要根据《国际海运固体散货规则》来进行预备、装载及承运。我们希望透过此通函在如何识别直接还原铁货物,及其正确及安全承运的问题上,给船东、船长和租船人提供一些指导。

货物中是否有直接还原铁(C)可通过化学成分识别,而承运人必需请货主提供相关资料。货物成分需含有总铁含量、金属铁含量及水分含量。如该批货物含有金属铁,那么该批货物必定是直接还原铁的衍生物:直接还原铁(A)及(B)通常含有约85%的金属铁含量;而含有直接还原铁(C)的混合金属铁含量可以低至1%至2%。这些混合货物应归类为危险货物直接还原铁(C),并应根据《国际海运固体散货规则》装运。如对货物有任何疑问,应立刻咨询所属的保赔协会。

在确定货物为直接还原铁(C)后,在装载货物前,发货人应根据《国际海运固体散货规则》向船长提供相关资料及文件。除一般要求外,客户也应该注意一些装运直接还原铁(C)的特别细节。我们现附上《国际海运固体散货规则》中直接还原铁(C)部分作为参考。请特别留意”装载” 及”注意事项” 的部分。

对于《国际海运固体散货规则》附录一中列明的货物,例如直接还原铁(C),根据第一条第五款的规定,只要这样的变通规定按照《国际海运固体散货规则》的要求是有效且安全的,允许主管当局授权订立其他规定或豁免条款。被认可的主管当局如下:出发港口国的当局,目的港口国的当局,以及船旗国当局。在任可符合此种豁免情形的航次之前,接受豁免者必须通知有关的其他主管当局,他们可能会接受此种豁免,但也有不接受的可能。

国际保赔协会认识到,虽然《国际海运固体散货规则》允许豁免规定,但仍然强烈建议其会员能够遵守《国际海运固体散货规则》对直接还原铁(C)的装运要求。若会员选择不遵守该要求,则必须满足其已通知了前文已列明的所有三家主管机构并接受了该豁免,而且须保证不会违反船旗国当地的管理规定,以及符合豁免要求的每艘运输固体散装货物的船舶上都须配有该豁免证书。

Information required when offered a shipment of Iron Fines that may contact DRI (C)

Recently IG Clubs have distributed a circular about Direct Reduced Iron (C) (DRI (C)) and we also would like to draw your attention to the same issue. Sometimes cargoes are offered and shipped that do not have DRI in their descriptions but in fact they contain a significant proportion of DRI (C) fines. For the cargoes with DRI in their descriptions, they should be declared using the appropriate Bulk Cargo Shipping Name (BCSN) for a DRI (C) cargo and prepared, loaded and carried in accordance with the IMSBC Code. This circular provides guidance to Shipowners, Masters and Charterers on the information to be requested to assist in the identification of DRI cargoes and the correct, safe practices for carriage.

Cargo blends containing DRI (C) can be identified by their chemical composition, details of which must be requested. The chemical composition must include the total iron content (Fe), the metallic (or free) iron content (Feo) and the moisture content. If the cargo contains any metallic iron (Feo), then it must be a DRI derivative: DRI (A) and (B) cargoes typically contain about 85% metallic iron, whereas in blends containing DRI (C) it can be as low as 1% or 2%. Such blended cargoes should be regarded as the hazardous commodity DRI (C) and be carried in accordance with the provisions of the Code. If in doubt, Members should consult their Association.

After identifying the cargo as DRI (C), shippers have to provide the information set by the IMSBC Code to the Master before loading. In addition to the general requirements, there are also some specific ones for DRI (C), we herewith attach an extracted part of DRI (C) from the IMSBC Code for your easy reference. Please pay much attention to the “Loading” and “Precautions” part.

For cargoes that are listed in Appendix 1 of the IMSBC Code, such as DRI (C), Section 1.5 allows a competent authority to authorize any other provision or exemption if satisfied that such alternative provision is at least as effective and safe as that required by the Code. Three competent authorities are recognized: the port State of departure, port State of arrival and the flag State. Prior to any shipment covered by such an exemption, the recipient of the exemption must notify the other competent authorities concerned, who may or may not accept that exemption.

The IG Clubs recognize that the Code permits an exemption but strongly advises their Members to adhere to the carriage requirements as detailed in the IMSBC entry for DRI (C). If Members choose not to follow this advice, they should satisfy themselves that all of the three competent authorities named above have been notified and have accepted the exemption, that the rules of the flag State Administration are not breached and that the exemption certificate is maintained on board each ship transporting the solid bulk cargoes in accordance with the exemption.
