This Circular is sent to clarify a few items in the Circular that was sent last week. This clarifications to our previous Circular is only meant for Charterers/Operators (and not the Owners of the vessels).
In order to further promote the application and incorporation of the 2011 Agreement into all NYPE/Asbatime charterparties, the International Group has drafted a charterparty clause and published a circular which we circulated to you last week Draft Charterparty Clause Promoting The Use of The Inter-club New York Produce Exchange Agreement 1996 (As Amended September 2011).
In our view, this clause is very good for the Owners. However, this clause is not favorable to the Time Charterers/Operators of the vessel.

货物索赔条款
本文旨在对上周发布通函中的部分内容做澄清，且仅针对租家/船舶经营人(不包括船东)。
上周我司发布了一则题为“国际保赔协会集团起草租约条款，以促进《保赔协会内部土产格式协议1996》(2011年9月修订)的使用”的通函。国际保赔协会集团为进一步促进2011协议的适用及将其并入到所有NYPE/Asbatime租约中，起草了推荐租约条款。
我们认为，该条款非常有利于船东，但对期租租家及船舶经营人不利。
