With the issuance of Normative Instruction 1356/13, starting from May 6th, 2013, the Brazilian Customs Authority has indicated that cargo receivers are no longer required to submit the original Bill(s) of Lading in order to obtain the release into their custody of cargo in bonded spaces.
In the past, many Members were aware of the Brazilian system which is unusual in that authorization to release cargo rests solely with Customs, instead of the shipping lines. However, agents may still block the release if freight is unpaid. Many P&I Clubs in the International Group have taken the position that Members’ cover was not prejudiced if they had delivered to Customs without original Bill(s) of Lading, but in compliance with local regulations which required them to do so.

巴西海关执法中的变化–无正本提单交付
巴西海关发布1356/13号规范指令,从2013年5月6日开始,收货人无须再提交正本提单以获得保税场所货物的放货。
以前,许多会员也知道巴西体系在授权放货这一点上的不同,它只与海关有关,而与航运公司无关。但是,如果未支付运费,代理人仍可能阻止放货。迄今,许多国际保赔协会集团的协会都认为如果其会员在无正本提单的情形下向海关进行了交付,只要该种行为是当地法规要求他们实施的,他们仍应当受到保护。
