Circular 1: Mandatory Requirements for Bridge Navigational Watch Alarm Systems (BNWAS) and Electronic Chart Display & Information Systems (ECDIS) (from SOE)
The Association would like to bring to the attention of their Members that the Maritime Safety Committee, at its eight-sixth session, adopted amendments to the International Convention for the Safety of Life at Sea that included amendments to Chapter V, Safety of Navigation. Regulation 19, “Carriage requirements for shipborne navigational systems and equipment”. These amendments include mandatory requirements for Bridge Navigational Watch Alarm Systems (BNWAS) and Electronic Chart Display & Information Systems (ECDIS). Details please refer to attached circular 1.
Circular 2: Ship-to-Ship (STS) Operations & Plans (from SOE)
The Association would like to bring to the attention of their members amendments to MARPOL73/78 adopted under Resolution MEPC. 186(59) that introduces a new Chapter 8 containing Regulations 40,41 and 42, with regard the “Prevention of Pollution during transfer of oil cargo between oil tankers at sea. Details please refer to circular 2.
Circular 3: California Block Stowage (CBS) Method (From API)
It has come to your Managers’ attention that some Members have recently been placed under pressure to agree to load steel cargoes using the California Block Stowage (CBS) method. The Club does not recommend the use of the CBS method in circumstances other than the shipping of steel slab cargoes between North and South America. Details please refer to Circular 3.
Circular 4: CHARTERPARTY CLAUSES: INDEMNITY FOR INSURED RISKS(From several IG clubs)
It has recently been reported by a number of clubs within the International Group that some charterers have been seeking to incorporate a certain clause into their charterparties, in particular in the container trades. For the reasons set out below, the clause in question has the potential to prejudice an Owner’s P&I cover and should not be agreed without considering the full implications of doing so. Details please refer to circulars No.4 from API, London, and BSM.

通函一:强制配备驾驶台航行值班报警系统(BNWAS)和电子海图系统(ECDIS)(From SOE)
海上安全委员会第68次会议讨论通过了对第五章V/19的修改条例,其中要求强制配备驾驶台航行值班报警系统(BNWAS)和电子海图系统(ECDIS)。该规定适用于所有新船,现有船舶的实施时间有所不同,具体参考通函一。
通函二:船对船过驳作业计划(From SOE)
国际海事组织以MEPC.186(59)决议通过修正案,新增第8章”防止海上油船间过驳货油造成污染”,规则于2011年1月1日生效,适用于2012年4月1日或以后的进行海上油船见货油过驳作业的150总吨及以上船舶。规则具体要求,请参考通函二。
通函三:California Block Stowage (CBS) Method (From API)
协会注意到最近一些会员迫于压力使用California Block Stowage (CBS)方法来装载钢板。CBS装载法是从加州钢铁业发展起来的的用在南北美洲之间的钢铁贸易的旨在通过减少人工操作来降低装卸成本的装载方法。但这一装载方法必须在专家的监督下进行。 协会并不推荐会员使用这种方法,除非是在南北美洲间的贸易。如果会员不得不用这种方法,则必须保证:
会员请提前通知并取得协会书面意见
这种方法只适用于箱型的货舱
积载时,确保钢板顶住舱壁,不留空隙
这种方法只适用于南北美之间的钢板贸易
必须由协会书面同意的经验丰富的第三方检验员检验方可
提单、租约、保函或其他文件的有关措辞请事先咨询协会意见,以最大程度保证会员利益

通函四:租约条款 – 保障保险范围内的风险(From API/BSM/London)
面对近期较多的租约合同下租家坚持并入有关保赔风险条款,尤其是在集装箱运输中,国际保赔集团下多家保赔协会都发出通函提请船东注意不要在租约中并入如下的条款:
“即使跟其它租约条款相悖,船东都将负责并保证租家免受保赔险承保范围内的风险。”
如在租约中并入上述条款,即使当租家有过错而产生的责任,也要由船东来承担。实际上,该条款会将船东变成租家的保赔协会,同时,该条款也阻碍了船东对租家行使追索请求权。对此,协会要求入会会员应该拒绝在租约中并入类似条款。如船东放弃追索请求权这将超出协会保赔险的承保范围;船东如欲并入类似条款,请提前通知并取得协会书面意见。具体参考通函四。
