In many cases where parties to a dispute decide to litigate, they will generate obvious costs of legal and possibly expert representation. However, adopting an adversarial position in relation to a valued commercial counterparty can also result in hidden costs in terms of loss of goodwill – and where the focus is on winning or losing, disputes can take on a life of their own.

In addition, the task of ensuring that a case is fully evidenced, whether through witness statements or contemporaneous documents, can present a significant drain on management time for a litigant, whilst the finality of a hearing and the uncertainty of third party determination of the issues can be stressful for the parties involved, leaving aside the length of time it may take for a judgment or Award to be published.

聚焦争议解决方案

在许多案件处理过程中,若争议双方致力于以诉讼方式解决争议,就必然产生诉讼费用并可能附带产生相应的专家代表费用。除此之外,以诉讼方式解决与有合作价值的商业伙伴间的争议,可能会因未表现出足够的善意而对商业信誉造成潜在损害。主要原因在于双方一旦将注意力集中在对案件输赢的关注上,就可能对争议发展进程失去控制。

除此之外,无论是通过提供当事人陈述,还是取自案件发生时的材料,以确保案件有足够的证据支撑,对于诉讼当事人而言都是一项费时费力的工作。而除了一项判决或裁决的作出往往必需经历较长的时间外,对于庭前聆讯的漫长准备以及第三方在庭上表现的不确定性都可能给诉讼当事方带来巨大压力。
