Institute Cargo Clauses (A) = All Risks?

It is commonly misunderstood in the marine industry that the Institute Cargo Clauses (A) “ICC A” of the marine cargo insurance would cover All Risks. Let us have a look of the Clause first – “Risk covered
1.This insurance covers all risks of loss of or damage to the subject-matter insured except as provided in Clauses 4, 5, 6 and 7 below”

Although it is mentioned “all risks of loss of or damage to”, there are some exclusions in the ICC (A). Those exclusions are related to War, Strikes (these two risks could be further covered, most of insurers now automatically provides cover for these two risks), Unseaworthiness, willful misconduct, ordinary leakage/loss in weight or volume/ wear etc. Even though the shipment is covered by the Marine Cargo Insurance with ICC (A) cover, in case the cargo is detained or confiscated by Customs or other officials or authorities, the cargo would not be covered by the insurance. It is because it is not relate to cargo loss (the cargo is still there) or damage (no damage at all), but due to some wrongful declaration of the cargo owner. Accordingly, ICC (A) does not cover “ALL RISKS”. Please consult your insurance broker for more information.

Marine Cargo Insurance arrangement for overage vessels

When cargo owner arranges Marine Cargo Insurance in China, insurers does concern the vessel quality. Besides the Classification and Flag, the vessel age is one of the major factor affecting the premium rate. In China, usually insurers would accept the vessel under 15-year old. If the vessel used over 15-year old, insurer may consider to charge the “Overage Additional Premium (OAP)”. Having said that, most of the Chinese underwriters would consider to charge the OAP when the vessel is over 25-year old. Unfortunately, most of the Chinese cargo underwriters would not accept vessel over 30-year old, even the owner is willing to pay the OAP.

Having said that, there are many potential underwriters in other countries are willing to cover the risks for the vessel over 30-year old, or non-IACS classed vessel. If you are interested, please feel free to share with us.

协会货物保险条款(A)= “一切”险?

很多人以为协会货物保险条款(A)”ICC A”货物运输保险能保障所有风险,其实这是一个普遍存在的误解。首先让我们来看看该条款的第一条 – “覆盖风险
1 – 该保险保障投保标的物的灭失或损坏的一切风险,於第4,5,6和7段除外”

虽然其中提到了”所有灭失或损坏的一切风险”,也有一些”ICC A”的除外风险。这些除外风险包括战争,罢工(现在大多数保险公司的自动提供这两种风险的保障),不适航,故意的不当行为,本质上滲漏/本质上减少重量或体积/本质上会磨损等损失等等。即使投保了”ICC A”,被扣留或者由海关或其他官员或当局没收的货物,並不受到保险的保障。这是因为它不涉及到货物灭失(货物仍然存在)或损坏(没有损毀),而主要是因为报关时一些货主的不当声明而引致。因此,事实上”ICC A”并不是保障”一切”险。投保时请咨询您的保险经纪以获得更多信息。

老龄船舶的运输保险安排

当货主在中国安排货物运输保险,保险人最为关心的是船只的质量。除了船级和船旗,船龄是影响保险费率的主要因素之一。在中国,通常保险公司会接受15岁以下的船只。如果船只超过15岁,保险公司可能会考虑收取“老龄船附加保费(OAP)”。尽管如此,其他地区仍有许多承保人愿意向超过30岁或者非IACS级的船只进行承保。如有任何疑问,请随时与我们分享。
