Due to recent enquiries about some owners wishing to trade their ships to Iran, we would make the following additional practical comments:
- Owners must carry out their own due diligence in checking whether the shipment and voyage is lawful.
- The P&I Clubs would only give to their members a guidance as to the applicable US and EU laws and would not undertake the obligation of this search to confirm whether the shipment is lawful.
- Some P&I Clubs recommend an expert surveyor is appointed for certain project cargoes to determine whether the cargo intended for Iran could possibly be used in connection with one of the unlawful activities such as nuclear technology and refining and production of oil and gas.
- In view of the US laws can be uncertain and complicated, a US law firm is recommended to assist with the checks and searches.

- 船东自身必须恪尽职守,检查所装载的货物和航次是否合法。
- 保赔协会就如何适用美国和欧盟法律为会员提供指导意见,但没有义务为会员调查确认其运营的特定航次是否合法。
- 对于某些项目货物,一些保赔协会建议会员聘请专门的调查人员,以确定拟运往伊朗的货物是否可能被用于与非法活动有关的活动,如核技术,精炼及生产石油和天然气。
