The customary exception clause in bills of lading to exclude the carrier’s liability for cargos loaded on deck will not be upheld in the Libyan courts unless the particular exception clause has been counter signed on the bill of lading by the shipper or a separate written acceptance of liability from the shippers or receivers produced.
