Protection-and-indemnity(P&I) clubs are pushing new charter-party language that legal experts say will help protect charterers in countries that hold them liable for criminal liability for spills regardless of fault.
The new language was developed by the International Group clubs in co-operation with the Baltic and International Maritime Council primarily in response to laws in Australia that hold charterers strictly liable for criminal fines and civil penalties in spills. Liability for such penalties has long been the province of owners and operators.

保赔协会正在推出一个新的租约条款措辞。法律专家表示,在一些国家,无论租家是否有过错,都需要对溢油承担刑事责任,在这样的国家,新措辞能够起到保护租家的作用。
该新措辞是由国际保赔协会集团联合波罗的海国际航运公会共同修订。主要目的是应对澳大利亚在溢油上的法律规定,其规定租家在溢油事故中,对刑事罚金和民事处罚承担严格的责任。长久以来,此类处罚责任都是由船东和船舶营运人承担的。
