The Club’s Circular no 003 2012 highlighted the exposure of voyage and time charterers to pollution claims in certain jurisdictions like Australia and New Zealand but which could arguably include countries such as Brazil and China. Legislation recently enacted in these countries can result in Charterers potentially being held strictly accountable, whether directly or jointly with the Owners, for losses, damages, fines or compensation arising out of an oil pollution incident including pollution from bunkers.

In our Circular we invited Assureds regularly trading to these jurisdictions to review their existing and future contractual terms insofar as pollution liabilities are concerned. Given the increased exposure faced by Charterers, we have drafted two (2) clauses (the “Clauses” ) specially designed to deal with pollution claims depending on whether the vessel is on time or voyage charter. While the Clauses are of worldwide application they can be adapted to suit a specific vessel/P&I Club, trade or jurisdiction and the Club will be available to assist in this respect. The Clauses are attached to this Circular.

供期租和程租租约使用的 “污染条款”

租家保赔协会2012年003号通函中强调了程租和期租的租家在某些地区面临污染索赔的风险,诸如澳大利亚、新西兰等地,也包括巴西和中国。按照这些地区颁布的法律,租家有可能直接或者和船东共同对包括燃油污染在内的油污事件所引起的损失、损害、罚款或赔偿,承担严格责任。

在本通函中,协会建议经常前往这些地区的被保险人检查其目前和将来所采用的有关污染责任的合同条款。考虑到租家面临越来越大的风险,协会专门起草了应对污染索赔的期租和程租条款。这些条款可在全球范围适用,也适合于某一特定的船舶/保赔协会、航行区域或者司法辖区,如有需要协会将在这方面给予会员帮助。具体条款,请见下文。
