In a recent case of Swissmarine Services SA v Gupta Coal India Private Limited [2015] EWHC 265 (Comm), where the claimant owner alleged that it had concluded a contract of affreightment (“COA”) with the defendant charterer on 3 October 2011 for six shipments of coal from Richards Bay, South Africa to Krishnapatnam or Revdanda, India. Two shipments were to be spread in 2011 and the remaining four in 2012. The COA contained an English law and jurisdiction clause.
The defendant made the first two nominations, by February 2012. The defendant had difficulties in nominating the last four shipments even when the Owners had given them extension. The Owners claimed damages for this repudiatory breach of COA, when last four nominations were not made.

毁约性违约及包运合同
在最近一个英国高院的判例Swissmarine Services SA v Gupta Coal India Private Limited [2015] EWHC 265(Comm)中,原告船东称,2011年10月3日,其与被告租家签订了一份包运合同,其中包括6个航次的煤炭运输,从南非Richards Bay至印度Krishnapatnam或Revdanda港口。合同约定2011年完成2个航次,2012年完成剩余的4个航次。包运合同适用英国法及管辖权条款。
截至2012年2月,被告指定了前2个航次。由于被告无法指定后4个航次,且在船东给出一定的时间宽限后,仍无法履约。船东就合同毁约性违约,提出损害赔偿。
