There was a recent case of KASSIOPI MARITIME CO LTD V FAL SHIPPING CO LTD (THE “M/T ADVENTURE”) [2015] EWHC 318 (Comm), 19 February 2015 on an appeal of an arbitration award on a question of law under section 69 of the Arbitration Act 1996. The question of law was whether the Owners’ claim for demurrage was time barred for not submitting all the documents with their claim within 90 days as prescribed by the clause in the charter party.
A vessel was chartered on an amended BPVOY4 form dated 15 June 2014. In this case, Owners brought a claim for demurrage in the amount of USD364, 847.78 by a formal letter dated 5 August 2011, which attached a number of documents such as invoice for demurrage, laytime calculation, NORs for two load port 4 Letters of Protest, pumping record for one of the discharge port, empty tank certificates and statement of facts for both the load and discharge port, but not e-mails regarding granting of free pratique that was relevant to running of laytime.

滞期费索赔的时效问题
KASSIOPI MARITIME CO LTD V FAL SHIPPING CO LTD (THE “M/T ADVENTURE”) [2015] EWHC 318 (Comm)是最近的一个案例。2015年2月19日,船东根据《1996年仲裁法》第69条有关“法律问题上诉”的规定,对该案的仲裁裁决提起上诉。上诉涉及的法律问题是,如果船东没有按照租约条款的规定在90天内递交所有与案件有关的文件,滞期费索赔是否会超过诉讼时效?
涉案船舶于2014年6月15日签订租约,采用经修订的BPVOY4格式。船东于2011年8月5日通过正式信函提出364,847.78美元的滞期费索赔,并随附多个文件,如,滞期费发票,装卸时间计算,2个港口的装卸准备就绪通知书,4份海事声明,其中一个卸货港的水泵打压记录,空舱证书和装卸时间事实记录。但是文件中缺少关于授予船舶入境卫生检疫证书的邮件,这关系到装卸时间的计算。
