The first test case “Res Cogitans” was first arbitrated and the tribunal found in favour of OWB/ING. Vessel owners appealed the award but the English High Court upheld the tribunal’s findings. The case is now under appeal.
The case involved the direct supply by an OWB subsidiary to the vessel owners just before the OW bankruptcy was announced. No payment was made by owners pending clarification of the party rightfully entitled to be paid for the bunker supply. OW Bunkers did not pay the physical supplier.

“Res Cogitans”案是丹麦燃油供货商宝运石油公司(OW Bunker)宣布破产后的首个相关案例。宝运石油/荷兰国际银行在最初的仲裁中获胜。船东不服裁决提起上诉，但英国高院支持仲裁庭的裁决。目前本案正在进一步上诉过程中。
所涉案情如下：宝运石油公司宣布破产不久前，其子公司向船东直接供油。宝运石油破产后，船东不确定哪一方有权收取油款，因此一直没有安排付款。而宝运石油亦没有付款给实际供油商。
