In the recent case of Classic Maritime Inc v Limbungan Makmur Sdn Bhd and Another – QBD (Comm Ct) (Teare J) [2018] EWHC 2389 (Comm) – 13 September 2018, a claimant shipowner (‘Owner’) entered into a long-term contract of affreightment (‘the COA’) with the defendant Limbungan Makmur Sdn Bhd (Limbungan), as charterer (‘the charterer’), for the carriage of iron ore pellets from Brazil to Malaysia.

According to the contract, iron ore pellets from Brazilian mining company Samarco Mineracao SA (Samarco) were shipped through Ponta Ubu in Brazil, and iron pellets from another Brazilian mining company, Vale SA (Vale), were shipped through Tubarao, also in Brazil.

在近期的Classic Maritime Inc v Limbungan Makmur Sdn Bhd and Another – QBD (Comm Ct) (Teare J) [2018] EWHC 2389 (Comm) – 13 September 2018一案中,原告船东与被告租家Limbungan Makmur Sdn Bhd订立包运合同(COA),将球团铁矿从巴西运往马来西亚。

根据合同,巴西采矿公司Samarco Mineracao SA (Samarco)提供的球团铁矿从巴西乌布角(Ponta Ubu)进行装船,而另一家巴西采矿公司Vale SA (Vale)提供的球团铁矿经同样在巴西的图巴朗港(Tubarao)进行装船。
