In a new case of Imperator I Maritime Company v. Bunge SA (Coral Seas) [2016] EWHC 1506 (Comm), a longstanding belief that a ship owner could argue hull fouling due to long stay as a defence in the context of continuous performance warranty was discarded by High Court.

In this case, a newly built vessel, The Coral Seas (‘the vessel’) was time chartered on an amended NYPE to a big charterer Bunge S.A. (‘Charterers’). There were no underperformance claims for one year, but after one year during the charter service, the Charterers ordered the vessel to proceed to the warm water port of Guaiba Island, Brazil.

那么船东对船舶履行能力不足负责

长期以来,人们认为,在船东就(船舶)持续性履行能力作出保证的情况下,对于船体污损,船东可以以“(船舶)长时间停留”为由抗辩。但在最近的Imperator I Maritime Company v. Bunge SA (Coral Seas) [2016] EWHC 1506 (Comm) 一案中英国高院否定了这一观点。

本案涉案船舶为一艘新造船“Coral Seas”,期租给规模较大的租家Bunge S.A.,租约为经修订的NYPE格式。租约期的第一年船舶没有履行能力不足的索赔,但一年之后,租家指令船舶前往位于温带水域的巴西瓜伊巴岛(Guaiba Island)的一个港口。
