In a new Hong Kong case , a very reputed maritime jurisdiction like England, Floata Consolidation Ltd v Man Hee Ling (Hong Kong) Vehicles Ltd and Others – [2016] HKCFI 622, High Ct of Hong Kong SAR (Court of First Instance) (Peter Ng J) – 12 April 2016, it was made clear that the fault of the derrick operator, and person in charge, on the barge (Mr S) fault cannot be attributed as ‘personal act or omission’ of the ship owners’ for the purpose of article 4 of the 1976 Limitation Convention. Therefore, the decree of limitation granted by the Hong Kong Court would not be set aside.

有如英国一样,香港是非常知名的海事辖区,2016年4月12日的新案例Floata Consolidation Ltd v Man Hee Ling (Hong Kong) Vehicles Ltd and Others – [2016] HKCFI 622, High Ct of Hong Kong SAR (Court of First Instance) (Peter Ng J) 阐明,根据《1976年海事责任限制公约》第4条的规定,起重机操作人员的过失以及趸船负责人(S先生)的过失,不能归咎为船东的“个人作为或不作为”。因此,香港法院的责任限制判令(限责令)不能被撤销。
