Developments - Sea of Azov

The development

Members will be aware of the continuing conflict situation in Eastern Ukraine.

The area of conflict has widened, but at present our correspondents advise that the ports of Mariupol and Berdyansk remain within the control of the Ukrainian Government.

The situation is, however, very volatile and may develop rapidly without warning.

This has included the media reported incident involving shore side artillery firing on Ukrainian naval vessels in that area.

Practical advice

Members with vessels at Ukrainian ports in the Sea of Azov, or due to call there in the near future, should seek regular updates - several times a day - as to the very latest situation with respect to safety and security.

Shore leave should be avoided and crews should remain close to their vessels at all times. Crew change overs should be postponed until a later time.

Chartering advice

Chartering teams should pay close attention to these developments, particularly if the conflict zone moves closer to the port cities.

Suitable charter terms include the use of applicable war clauses.

Even if it is expressly agreed to call at Ukrainian ports in the Sea of Azov, an express safety warranty and liberty to deviate / abort the port of call should be retained so that the master retains unfettered discretion to take any necessary step to ensure the safety of the crew and vessel at all times. Such being required in any event under SOLAS.
